By purchasing or using DIGIGEN’s AI Receptionist services, you agree to the terms outlined below.

1. Service Description

DIGIGEN LLC provides AI-powered receptionist services designed for home-service businesses. The AI system answers, routes, and follows up with calls and messages based on custom scripts and integrations defined during onboarding.

2. Pricing and Billing

  • All pricing is clearly listed on the checkout page.

  • A one-time setup fee applies to all plans and is billed upon signup.

  • Subscription fees are charged monthly or annually, depending on your selected billing cycle.

  • Overage fees apply for usage beyond the included monthly AI call minutes. Rates vary by plan.

  • DIGIGEN reserves the right to change pricing with 30 days’ notice.

3. No Refund Policy

All sales are final. We do not offer refunds for setup fees, monthly subscriptions, or overage charges. By signing up, you agree to this no-refund policy.

4. Cancellation and Renewal

  • You may cancel your subscription at any time before the next billing cycle.

  • Cancellations must be submitted through your customer portal or by contacting [email protected].

  • Annual subscriptions will auto-renew unless cancelled at least 7 days prior to renewal.

5. AI Limitations

Our AI receptionist uses advanced natural language processing but may not perfectly understand or handle every caller or situation. The system will follow fallback protocols (e.g., message capture or call routing) as configured.

DIGIGEN does not guarantee 100% call accuracy or availability and is not responsible for lost business due to system misinterpretations, outages, or user configuration errors.

6. Acceptable Use

You may not use the service for illegal activity, harassment, false representation, or in industries prohibited by law. DIGIGEN reserves the right to suspend accounts for misuse, abuse, or behavior that compromises system integrity.

7. Data and Privacy

DIGIGEN follows industry standards for data encryption and access control. However, we do not guarantee complete data security and are not liable for unauthorized access due to third-party breaches.

8. Intellectual Property

All scripts, configurations, and AI workflows developed by DIGIGEN remain the intellectual property of DIGIGEN LLC. Clients are granted a non-transferable license to use these during their active subscription.

9. Limitation of Liability

To the fullest extent permitted by law, DIGIGEN LLC is not liable for indirect, incidental, or consequential damages resulting from use of its services. Total liability will not exceed the amount paid in the prior 3 months of service.

10. Indemnification

You agree to indemnify and hold harmless DIGIGEN LLC and its employees from any claims, liabilities, damages, or legal costs arising from misuse of the service or violation of these terms.

11. Governing Law

These terms are governed by the laws of the State of Florida. All disputes shall be resolved in courts located in Palm Beach County, Florida.
